  • Häusliches Arbeitszimmer: Kein Abzug für Umbau des privat genutzten Badezimmers

    Kosten für den Umbau eines privat genutzten Badezimmers gehören nicht zu den abziehbaren Aufwendungen für ein häusliches Arbeitszimmer. Dies hat der Bundesfinanzhof (BFH) mit Urteil vom 14. Mai 2019 - VIII R 16/15 entschieden.


    Im Streitfall hatten die zusammen veranlagten Kläger im Jahr 2011 das Badezimmer und den vor-gelagerten Flur in ihrem Eigenheim umfassend umgebaut. In dem Eigenheim nutzte der Kläger ein häusliches Arbeitszimmer für seine selbständige Tätigkeit als Steuerberater, das 8,43% der Gesamtfläche ausmachte. Der Kläger machte für das Streitjahr 8,43% der entstandenen Umbau-kosten gemäß § 4 Abs. 5 Satz 1 Nr. 6b Sätze 2 und 3 des Einkommensteuergesetzes als Betriebs-ausgaben im Zusammenhang mit seinem häuslichen Arbeitszimmer geltend. Diese Aufwendungen in Höhe von rund 4.000 € berücksichtigte das FA – mit Ausnahme der Kosten für den Austausch der Tür zum Arbeitszimmer – nicht. Das hat der BFH nunmehr als dem Grunde nach zutreffend angesehen.


    Nach dem Urteil des BFH sind Renovierungs- oder Reparaturaufwendungen, die wie z.B. Schuld-zinsen, Gebäude-AfA oder Müllabfuhrgebühren für das gesamte Gebäude anfallen, zwar nach dem Flächenverhältnis aufzuteilen und damit anteilig zu berücksichtigen. Nicht anteilig abzugsfähig sind jedoch Kosten für einen Raum, der wie im Streitfall das Badezimmer und der Flur der Kläger ausschließlich --oder mehr als in nur untergeordnetem Umfang-- privaten Wohnzwecken dient. Erfolgen Baumaßnahmen in Bezug auf einen privat genutzten Raum, fehlt es an Gebäudekosten, die nach dem Flächenverhältnis aufzuteilen und anteilig abzugsfähig sind.


    Da das Finanzgericht (FG) keine hinreichenden Feststellungen zu ebenfalls streitigen Aufwen-dungen für Arbeiten an Rollläden des Hauses der Kläger getroffen hatte, konnte der BFH allerdings in der Sache nicht abschließend entscheiden und verwies die Sache an das FG zurück. Sollte es dabei um die Rollladenanlage des Wohnzimmers gegangen sein, lägen auch insoweit keine ab-ziehbaren Aufwendungen vor.
